Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and EternalMind Labs ("EternalMind Labs," "we," "us," or "our") and govern your access to and use of Mindleaf, our journaling and self-reflection app and related services (together, the "App"). By creating an account or using the App, you agree to these Terms. If you don't agree, please don't use the App.

1. Eligibility

You must be at least 17 years old to create an account or use Mindleaf. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your account

You're responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account. Let us know right away at the contact below if you suspect any unauthorized use.

You can permanently delete your account and Your Content at any time from Settings within the App. We recommend exporting anything you'd like to keep first, since deletion is irreversible.

3. Your content

"Your Content" means the journal entries, conversations, voice reflections, personality results, and anything else you create, upload, or generate within the App. You retain full ownership of Your Content.

By using the App, you grant us a limited, non‑exclusive license to store, process, encrypt, transmit, and display Your Content solely as needed to provide and improve the App's features for you (for example, generating summaries, syncing across your devices, or powering conversations with Bud). This license ends when you delete the relevant content or your account, except for residual copies that may briefly remain in backups until they are purged in the normal course of business.

4. AI features and Bud

Mindleaf uses artificial intelligence — including our in‑app companion, Bud — to help you reflect, generate journal entries, summarize your week, and offer prompts and suggestions. AI‑generated content is produced automatically and may sometimes be inaccurate, repetitive, or not fully reflect your intentions. Please use your own judgment when relying on anything Bud or the App generates.

Mindleaf and Bud are not a substitute for professional mental health care. The App is designed to support reflection and self-understanding — it is not a medical device, therapy, or crisis service, and is not intended to diagnose, treat, or provide advice for any mental health condition. If you are in crisis or experiencing a mental health emergency, please contact a licensed professional or emergency services in your area immediately.

5. Subscriptions and purchases

Some features of Mindleaf — including premium plans and "leaves" used to unlock AI features — are offered through auto‑renewing subscriptions or one‑time purchases processed entirely through Apple's App Store using Apple's in‑app purchase system. Pricing, billing, and renewal terms are presented before you confirm a purchase.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings — we don't have the ability to process cancellations or refunds directly, as these are handled by Apple in accordance with their policies.

"Leaves" and similar in‑app credits have no cash value, cannot be exchanged for money, and are non-transferable between accounts.

6. Acceptable use

When using Mindleaf, you agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to access another user's account or data without authorization;
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
• Interfere with, disrupt, or attempt to gain unauthorized access to our systems, servers, or networks;
• Use automated means (bots, scrapers, etc.) to access or collect data from the App; or
• Misrepresent your identity or impersonate any person or entity.

7. Intellectual property

The App, including its design, branding, mascot ("Bud"), text, graphics, and underlying software, is owned by EternalMind Labs and protected by intellectual property laws. Other than the limited right to use the App for its intended purpose, these Terms don't grant you any rights to our trademarks, designs, or content.

8. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if we reasonably believe you've violated these Terms, created risk or legal exposure for us, or if we discontinue the App. Where reasonably possible, we'll try to give you notice before doing so.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including (to the extent permitted by law) any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, EternalMind Labs and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or your use of the App will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the App will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you in the App or by email before they take effect. Continuing to use the App after changes become effective means you accept the updated Terms.
